Shelter Valley Aggregates/Omni Commerce Ltd., filed a Consent Application requesting an easement/right-of-way for an exit from the proposed SVA pit to the proposed haul route, Turk Road East.
The Lower Trent Conservation Authority (LTCA) recommends that this Application for a severance of 3.5 acres be deferred because:
a) the proposed severance would be close to a headwater of Cold Creek;
b) the proposed severance raises erosion and water quality concerns;
c) the proposed access route crosses a portion of the Tubbs Corner(s) Significant Natural Area;
d) the application does not detail the proposed land use (design or use of the haul route)
The LTCA wants a detailed topographic survey (contour interval of one metre) showing the severed parcel and proposed changes to existing grades, and a report addressing the potential impacts on the Tubbs Corners Significant Natural Area.
A/H COUNCIL WILL VOTE WHETHER TO APPROVE, DEFER OR DENY THE CONSENT APPLICATION;
CONDITIONAL UPON an amendment to Restricted Area Zoning Bylaw No. 619 coming into force and effect;
CONDITIONAL UPON the payment of a $2 833.00 Residential Development Fee.
What do these 'conditionals' mean?
Do they mean Council can overrule the concerns of the LTCA?
